These Gift Card Terms & Conditions ("Gift Card Terms") apply to all Green Nation Life gift cards ("Gift Cards") issued by Stirling and Hinds Pty Ltd (ABN 96 638 020 176) trading as Green Nation Life ("we", "us", "our"). By purchasing, receiving or using a Gift Card, you agree to these Gift Card Terms. These Gift Card Terms apply in addition to our Terms & Conditions. If there is any inconsistency, these Gift Card Terms prevail in relation to Gift Cards.
Nothing in these Gift Card Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
1. Purchasing a Gift Card
- Gift Cards are digital only and are available in the denominations shown on our website. All values are in Australian Dollars (AUD).
- Gift Cards are delivered by email to the purchaser or, where the purchaser chooses, directly to a nominated recipient on a nominated date. Delivery is free and no fees apply to the purchase of a Gift Card.
- The purchaser is responsible for ensuring the recipient's name and email address are entered correctly. If a Gift Card is sent to an incorrect email address because of an error made by the purchaser, please contact us as soon as possible. Where the Gift Card has not yet been used, we will cancel it and reissue it to the correct email address. We are not responsible for any balance used before we are notified.
- If you have not received your Gift Card within 24 hours of the purchase or the nominated delivery date, please check your junk or spam folder and then contact us.
- Gift Cards cannot be purchased using another Gift Card.
- Discount codes and promotional offers cannot be applied to the purchase of a Gift Card, unless the offer expressly states otherwise.
- We may limit the number or total value of Gift Cards purchased in a single order or by a single customer.
2. Validity and Expiry
- Purchased Gift Cards are valid for 3 years from the date of purchase. The expiry date is shown on the Gift Card email.
- Any balance remaining after the expiry date cannot be used and will not be refunded, except where required by law.
- Gift Cards issued free of charge (for example as a prize, giveaway, reward or customer service gesture) may have a different validity period, which will be stated when the Gift Card is issued. See section 9.
3. Using a Gift Card
- Gift Cards can only be redeemed for purchases on our website, greennationlife.com.au. Gift Cards cannot be redeemed with our stockists or any other third-party retailer.
- To redeem a Gift Card, enter the Gift Card code at checkout. The order value (including shipping) will be deducted from the Gift Card balance.
- Gift Cards can be used over multiple orders until the balance is used or the Gift Card expires. Any unused balance remains on the Gift Card until the expiry date.
- If the order total exceeds the Gift Card balance, the remaining amount must be paid using another accepted payment method.
- Gift Cards can be used to purchase full-priced and sale items and may be used together with valid discount codes, unless the terms of a particular promotion state otherwise.
- Gift Cards cannot be used to purchase other Gift Cards.
- Gift Cards cannot be reloaded or topped up.
- You can check your Gift Card balance using the link in your Gift Card email, at checkout, or by contacting us.
4. No Cash Value and No Fees
- Gift Cards cannot be exchanged for cash, credit to a bank account or card, or any other form of payment, except where required by law.
- We do not charge any fees for the purchase, delivery, activation, use, balance enquiry or holding of a Gift Card.
5. Refunds
- We do not offer refunds for change of mind on the purchase of a Gift Card. This does not affect your rights under the Australian Consumer Law.
- If a Gift Card is faulty or cannot be used because of an error on our part, please contact us and we will reissue the Gift Card or refund the purchase price.
- If you return or receive a refund for products purchased using a Gift Card, the amount paid by Gift Card will be refunded to the Gift Card, and any amount paid by another payment method will be refunded to that payment method. If the original Gift Card has expired or will expire within 3 months of the refund, we will issue a new Gift Card for the refunded amount, valid for at least 3 months.
- Refunds for products purchased with a Gift Card are otherwise subject to our Shipping & Returns policy.
6. Lost, Stolen or Unauthorised Use
- Please treat your Gift Card code like cash and keep it secure. Anyone who has the code can use the Gift Card.
- If your Gift Card email is lost or deleted, contact us and we will resend it to the email address it was originally sent to.
- If you believe your Gift Card code has been lost, stolen or used without your permission, contact us as soon as possible. If you can provide proof of purchase, we will cancel the Gift Card and issue a replacement for any balance remaining at the time we cancel it.
- We are not responsible for any balance used before we are notified, except to the extent the loss was caused by our negligence or breach of these Gift Card Terms.
7. Resale and Fraud
- Gift Cards must not be resold, offered for sale, or used for any commercial purpose without our written consent.
- We may cancel or refuse to honour a Gift Card, or refuse an order, where we reasonably believe the Gift Card was obtained fraudulently or unlawfully (including through unauthorised payment) or has been resold in breach of these Gift Card Terms. Where a Gift Card is cancelled, we will tell the holder where it is lawful to do so.
8. Personal Information
We collect the names and email addresses of purchasers and recipients to deliver Gift Cards, provide customer support and prevent fraud. We handle personal information in accordance with our Privacy Policy. By entering a recipient's details, you confirm you are authorised to provide them to us for this purpose.
9. Promotional Gift Cards
Gift Cards provided free of charge, including as a competition or giveaway prize, reward, or customer service gesture ("Promotional Gift Cards"), are subject to these Gift Card Terms, except that their validity period and any other conditions stated at the time of issue (or in the relevant promotion terms) will apply. Promotional Gift Cards have no cash value and cannot be exchanged, transferred for value, or refunded.
10. Changes to these Gift Card Terms
We may update these Gift Card Terms from time to time by publishing the updated version on our website. Changes will not reduce the value or validity period of, or otherwise adversely affect, any Gift Card purchased before the change takes effect.
11. Governing Law
These Gift Card Terms are governed by the laws of the State of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria.
